Privacy Policy
This Privacy Policy (also referred to as, the “Policy”) sets forth the policies and practices of The New York Opportunity Network, Inc. (henceforth referred to as “OppNet”, “we”, “us”, or “our”) with respect to personal information we collect about you, how we use and share that information, and the privacy choices we offer. This Policy applies to the information provided to us, or otherwise collected by us, through this website (the “Site”). This Policy does not apply to information collected by or provided to (a) OppNet offline or on any other website operated by OppNet or any third party, including Service Providers (as defined below) or (b) any third party, including Service Providers and including through any webform, application or content (including any payment portal or application) that may link to or be accessible through the Site, such as Google Forms, FormAssembly, and Automatic Data Processing (“ADP”).
By accessing the Site, or otherwise providing us with any information, you agree that you have read and understand the terms and conditions of this Policy. Use of this Site is also subject to the OppNet Terms of Use. If you do not agree with this Policy and the Terms of Use, do not use the Site.
1. OUR POLICY
We recognize the value of your privacy and encourage you to read this Policy in its entirety as it sets forth our policies with respect to personal information you provide us through our Site, or through other means. “Personally Identifiable Information” refers to information that allows us to identify you, including, but not limited to, your first and last name, email address, postal address, zip/postal codes, and telephone number. By providing us with any information, you represent that you are authorized to disclose and provide us with such information and that the information you provide to us is true and accurate. Do not provide information about others unless you are authorized to do so and have obtained the necessary consents from such individuals under applicable data privacy and protection laws, rules and regulations to have all information used, disclosed, and transferred in accordance with this Policy. By submitting information about others, you represent and warrant that you are authorized to do so and that you have received authorization from the person about whom you are providing the information and that person has consented to have all information used, disclosed, and transferred in accordance with this Policy and applicable data privacy and protection laws, rules and regulations.
2. PERSONALLY IDENTIFIABLE INFORMATION COLLECTED
At our Site, we collect Personally Identifiable Information when voluntarily submitted by a visitor or another person acting on such visitor's behalf, including through website forms, email communications and other means.
OppNet may also receive certain information automatically from your web browser or applications you use when you access our website, including, for example, IP addresses, other device identifiers, browser types, operating systems, access dates and times, referring and exiting URLs, etc.
If you choose to make a donation to OppNet through this Site, OppNet and its Service Providers will collect certain required Personally Identifiable Information and financial-related information from you (such as your credit card information, billing address and the donation amount). Online donations are processed by our Service Provider. Upon completion of your donation, OppNet will receive only the last four digits of your credit card number and the card type from the processor. All other financial-related information is retained by the processor. Please read the section below entitled “Links and Third-Party Web Sites” and familiarize yourself with the privacy policy and terms of use of all such third-party sites before using them.
Applicants to our programs may be asked to supply certain Personally Identifiable Information in their applications. For any applicants under the age of 18, parental consent forms must be signed in order for the application to be considered. If parental consent is not received by the time we conduct applicant interviews, we will not consider the applicant for our program. We do, however, reserve the right to retain information contained in the application to be used solely for internal purposes (including backups and archiving, prevention of fraud and abuse, and analytics) for 6 years or longer if required by law. We may share our statistical analyses with our affiliates and partners (e.g., education institutions and funders) on an anonymous basis that will not include your name or identify you in any manner.
Further, by visiting our Site, you may have the opportunity to request information from OppNet, in which case we may request that you provide an e-mail address or other contact information to allow us to comply with your request, and for other purposes as may be disclosed at the time the request is made. If you request information from OppNet or make a donation to OppNet, we may add your e-mail address or other contact information to our mailing list and contact you from time to time. You may elect to opt-out of receiving communications other than those relating to a specific query by following the procedures in the section below entitled “How to Request Changes or Opt-Out of Future Communications”.
3. COLLECTION OF DATA FROM CHILDREN UNDER THE AGE OF 13
The Site and services made available through the Site are not intended for children under 13 years of age. No one under the age of 13 may provide any information to or on the Site or otherwise to OppNet. We do not knowingly collect any personal information from children under the age of 13, and we ask that you not provide us with any such information, while using this Site. If you are under 13, do not use or provide any information on this Site or through any of its features.
In the event that we become aware that a user of this Site is under the age of 13, and that he or she has provided us with personal information without verification of parental consent, we will not maintain or use such personal information, and we will delete such personal information from our records as soon as reasonably possible. If you believe we might have any information from or about a child under 13, please contact us at online@opportunitynetwork.org.
4. HOW WE MAY USE THE INFORMATION SUBMITTED
We may use the Personally Identifiable Information you provide to OppNet in accordance with the consent provided to us by you on the Fellows Program Application and where applicable law permits us to do so, including for any of the following purposes:
- To verify your identity, vet volunteer-applicants, review student-applicants for acceptance to the OppNet Fellows Program, and contact the student-applicant's school regarding any missing requested application information;
- To respond to your questions, and send you materials or information that you have requested;
- To provide the Site and its contents and any services you have requested;
- To communicate with you via text message and/or email, update you on the status of your application, remind you of any pertinent application-related deadlines, and notify you of events, news, information or other communications that may be of interest to you;
- To process donations, and solicit you from time to time for donations;
- To conduct market research, monitor trends, and conduct statistical analysis;
- To improve the Site and services offered, and better understand how users access and use our Site and services.
- To prevent, investigate or address fraud or other unauthorized or illegal activities; and
- To resolve disputes, comply with applicable legal or regulatory requirements, respond to requests from law enforcement or regulatory agencies, enforce our agreements and policies, and protect our rights and the rights and safety of others.
This Policy also applies to content, business information, ideas, concepts, or inventions that you send to OppNet by e-mail or through means other than the use of this Site. If you wish to keep any information private or proprietary, do not send such information in an e-mail or otherwise provide it to us.
OppNet will use one of the permitted grounds under applicable law to process your Personally Identifiable Information. Such grounds include instances where you have given your consent or where your consent is not required under applicable law, such as where OppNet is required to comply with a legal obligation, or where OppNet, or a third party acting on our behalf, including a Service Provider, determines that it is necessary for our legitimate interests to collect and use your Personally Identifiable Information.
The legitimate interests to collect your Personally Identifiable Information may include any of the purposes identified above and any other purpose where OppNet, or a third party acting on our behalf, including a Service Provider, has determined that you have a reasonable expectation for OppNet or a third party, including a Service Provider, on our behalf, to collect or use your Personally Identifiable Information for such purpose.
5. DISCLOSURE OF AND ACCESS TO YOUR INFORMATION
Subject to applicable law, we may disclose your Personally Identifiable Information:
(i) where you have provided your consent, as described at the time of such consent;
(ii) to fulfill the purpose for which you provide it or for any other purpose disclosed by us when you provide the information;
(iii) to assigned volunteers—with the express consent of you or your guardian—for purposes of facilitating communication;
(iv) to assigned OppNet Fellows, unless you have provided notice to OppNet that you do not consent to such disclosure;
(v) to affiliates or subsidiaries solely for the purpose of providing the Site and related services;
(vi) to (1) a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution or sale or transfer for some or all of OppNet’s assets, whether as a going concern or as part of a bankruptcy, liquidation or similar proceeding, in which Personally Identifiable Information held by OppNet about our Site, users, students or volunteers is among the assets transferred or (2) a person or entity to whom OppNet transfers any of our rights or obligations under any agreement;
(vii) to unaffiliated third parties, attorneys, accountants and advisors who provide OppNet with assistance or advice or are under contract to perform services for or on behalf of OppNet (collectively, “Service Providers”), who will be required to uphold and maintain our policies with respect to privacy, confidentiality, and the treatment of your Personally Identifiable Information, provided that any Service Provider’s access and use of your Personally Identifiable Information will be limited to the purpose for which such information was provided to our Service Provider;
(viii) as part of a legal process, if otherwise compelled to do so by law or in connection with any government or self-regulatory organization request or investigation;
(ix) to any person or entity to whom OppNet has a right or obligation to disclose your personal information under applicable law, or any person where OppNet determines that disclosure is necessary to protect or defend our property or other legal rights (including, but not limited to, enforcement of our agreements), or the rights, property, or safety of others;
(x) in order to investigate and defend ourselves against any third-party claims or allegations, or in furtherance of an investigation regarding a breach of the Site rules and policies, unauthorized access to or use of the Site or any other abusive or illegal activities;
(xi) to detect, prevent or otherwise address fraud, security, or technical issues; or
(xii) where we believe disclosure is necessary to provide a service that you have requested, or as otherwise authorized or directed by you.
We do not sell your Personally Identifiable Information to third parties, and we do not exchange your Personally Identifiable Information with other organizations for purposes of solicitation or cross-context behavioral advertising.
If you sign petitions, join groups or otherwise attach your Personally Identifiable Information to our initiatives, such information may be displayed on our Site or otherwise be publicly available.
6. HOW WE STORE YOUR INFORMATION
The servers where we store your Personally Identifiable Information are located in the USA, which may have less protections than your jurisdiction of residence. If you are located in another jurisdiction, you should be aware that your Personally Identifiable Information, once submitted, will be transferred to our servers. Please do not use this Site if you do not agree to the transfer and processing of your Personally Identifiable Information by OppNet as described in this Policy or if it is illegal to do so in your home jurisdiction.
OppNet will generally keep information about you for as long as necessary in relation to the purpose for which it was collected, as set forth in this Policy, or for such longer period if required under applicable law, or necessary for the purposes of OppNet's other legitimate interests.
7. CONSENT TO PROCESSING
Subject to your opt-out choices and all of the provisions contained in this Policy, you hereby consent to the collection, processing, use, disclosure, and transfer by OppNet of your Personally Identifiable Information for the limited purposes described under this Policy. Your consent relating to a right to transfer information referred to in this paragraph shall be deemed to include your consent to the transfer of your Personally Identifiable Information to jurisdictions that may have different levels of privacy protection than that available to you under your local law.
8. DATA SECURITY
To maintain data accuracy, prevent unauthorized access or disclosure, and ensure the correct use of information, we have put physical, technical, and administrative safeguards in place designed to safeguard Personally Identifiable Information we collect from you. We utilize SSL (Secure Socket Layer) technology, which encrypts our visitors’ credit card numbers, names, and addresses. Our third-party data processor is PCI-DSS certified. Credit card information is passed over a secure connection from this third party to the payment processor.
Unfortunately, no data transmission over the internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your Personally Identifiable Information, you acknowledge that: (i) there are security and privacy limitations which are beyond our control; (ii) the security, integrity, and privacy of any and all information exchanged between you and us cannot be guaranteed; and (iii) any such information may be viewed or tampered with in transit by a third party. Any transmission of Personally Identifiable Information is at your own risk.
9. COOKIES
OppNet or a third-party web analytics service (such as Google Analytics) acting on our behalf may send text files (e.g., “cookies” or other cached files) or images to your web browser to store information on your computer. We may use these files and images for technical convenience to store information on your computer. Such information may be used to allow our Site to recognize you and your preferences, which may improve your experience while using our Site. For example, we may use a session cookie to store form information that you have entered so that you do not have to enter such information again. In addition, we may use information stored in such text files and images to customize and monitor your experience and use of this Site. Our Site currently only uses four strictly necessary first-party cookies (also known as “HTTP cookies”). You may set your browser to notify you when you receive a cookie. Many web browsers also allow you to block cookies. If you block cookies, you may not be able to access certain parts of this Site. You can disable cookies from your computer system by following the instructions on your browser or at https://www.allaboutcookies.org.
10. LINKS AND THIRD-PARTY WEB SITES
The Site contains hyperlinks or “links” to other websites and applications not owned or controlled by OppNet. For example, online donations to OppNet may be facilitated by non-affiliated Service Providers. When you follow links to make such a donation, you will be linked to our Service Provider's website, which may be subject to a separate privacy policy and other terms and conditions. In some cases, these other web sites are made available via “framing technology,” and may appear to be part of our Site. We urge you to familiarize yourself with the individual privacy policy and other terms for each linked or framed site prior to submitting any Personally Identifiable Information. We are not responsible or liable for the data collection, privacy and information collection, usage or sharing policies and procedures or the content of such third-party websites. This Policy applies only to information collected by this Site or in the method(s) otherwise discussed herein.
11. HOW TO REQUEST CHANGES OR OPT-OUT OF FUTURE COMMUNICATIONS
If you would like to receive a copy of the Personally Identifiable Information we have received from you, please send a request to info@opportunitynetwork.org. If this information is incorrect or incomplete, please let us know, and we will correct or update it promptly. You may also ask us to remove your name and other Personally Identifiable Information from our database, in which case we will make all reasonable efforts to do so, subject to legal and record retention requirements, technology limitations and other considerations. In order to stop receiving non-essential electronic communications from us, you may unsubscribe to our publications and other non-essential communications by following the unsubscribe directions included at the end of each e-mail we send, or by visiting our Site, www.opportunitynetwork.org, and following the unsubscribe instructions. In addition, you may always contact us at 646-237-4091, or via e-mail to info@opportunitynetwork.org, to update your communications preferences.
12. CHANGES TO THIS POLICY
This Policy may be updated at any time, in which case the revised Policy takes effect the date it is posted or such other date indicated on this Site. To the extent practicable, we will use reasonable efforts to post to the Site any material changes to this Policy before the changes taking effect. After the changes take effect, all current and new information will be subject to the terms of the revised Policy. Your access to or use of the Site following a change to the Policy shall be deemed to be your consent to the revised Policy. We recommend and encourage you to visit our website periodically to view the most recent version of our Policy.
13. OTHER TERMS
No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
Your use of our Site is subject to and contingent upon your agreement with other terms and conditions on the Site and in any agreement between you and OppNet, which are hereby incorporated by reference. Except as described in this Policy, OppNet will not use your Personally Identifiable Information for any other purpose unless we first obtain your express authorization.
